Carefully read these terms and conditions, which will apply if you wish to proceed with the purchase of any product from Ferguson's. Ferguson's may, at its discretion, make changes, modify, add or remove these terms at any time. Please check these terms periodically for any changes and print off a copy to keep for reference.
1. DELIVERY
Delivery of goods will be deemed to have taken place when they are taken from our vehicle at your chosen delivery address. Please inspect all goods on delivery and advise us of any visible damage within a reasonable time.
Please note that all orders made between the 23rd of December 2010 and the 4th of January 2011 will not be processed until the 5th of January 2011. We apologise for any inconvenience this may cause.
2. VAT
All prices quoted include VAT at the prevailing rate. Should government legislation regarding VAT change prior to the delivery of the goods we reserve the right to impose any increase charges in respect of VAT.
3. RETURNS
We offer a full money back guarantee for items purchased from our website or via the telephone with our Internet Sales Department, if returned with the original packaging within 7 working days following the day of delivery.
4. WEBSITE INACCURACY POLICY
The information, services and products provided on and throughout this site are subject to change without notice. In the event of a genuine website error or inaccuracy we reserve the right to withdraw an offer immediately. Ferguson’s reserve the right to cancel all confirmed orders that are subject to genuine website error or inaccuracy. All products offered are subject to availability.
Customer Account
When you create a new user account at www.fergusonschocolates.co.uk we collect your name and E mail address. If you place an order for a product that requires payment, we also collect your credit card billing address, credit card information, and telephone number. This information will be used to process orders and, if necessary, to contact you regarding the status of your orders.
In order to develop our business we do use some of the collected data including recipient details to profile you and your order profile. This data is used to improve our service to you and identify new customers who we should be marketing to. This involves passing information onto selected third party companies.
Sharing your information with other companies
We have a firm commitment to protect your privacy and security as our customer. We are obliged by the Distance Selling Directive, and the Data Protection legislation, and all current Trade and Legal precedents and policies to respect your wishes. You can at any time contact us and we will OPT you out of any aspect of our marketing programme.

A record is kept of your purchases. Your previous orders may be used to present you with the most relevant products and gift ideas and to provide you with a better overall user experience. You have the right through Data Protection legislation to request, for a small fee, any data we hold on you. Will my customer contact information be disclosed to third parties?
If you Opt-In to receive information from third parties then we will provide selected companies with information about you. Please see the 'Opt-in' Policy section above. Ferguson’s also reserves the right to co-operate with law enforcement officials in the investigation of alleged unlawful activities of our customers or relating to our customers. We will have no legal liability for such disclosures.
Are my personal messages private when I purchase gifts?
When you add a personal message to an order, your message will be printed on a gift card that is part of the dispatch stationery. This is positioned so the message cannot be read during transit.
What are cookies and how do we use them?
